People v. I.M.
Our client was charged with assault following a dispute with a former partner. This charge was a retaliatory, “stale” allegation that followed a prior incident where the partner had been arrested for assaulting our client. Due to the partner’s family connections within local law enforcement, those original charges were dismissed before our firm was retained. In an attempt to further derail our client’s life, the partner reported them to federal immigration authorities, leading to our client’s removal and deportation.
We provided zealous advocacy, arguing that because our client had been deported by federal authorities, the case could not justly proceed and must be dismissed in the interest of justice. Outside the courtroom, a member of the partner’s family—who holds a position in law enforcement—attempted to use their professional status to intimidate our team and disparage our client’s character. We stood our ground, highlighting the hypocrisy of the situation and the prior history of violence committed by the partner.
Ultimately, by highlighting the procedural injustice of the arrest and the circumstances of the deportation, we successfully moved the court for a full resolution. The District Attorney’s office reviewed the file and agreed to dismiss all charges. Although our client remains abroad, they no longer face a criminal record or outstanding warrants in the United States, effectively restoring their history and protecting their future legal standing.
